General Terms and Conditions for the online shop of Kijimea Inc.

THESE GENERAL TERMS AND CONDITIONS CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS.
1 – General, Scope
These General Terms and Conditions (hereinafter, the "GTC") constitute an agreement between Kijimea Inc. (“Seller" or "we") and each user ("you" or "customer") of our website (www.kijimea.com) and mobile site (collectively the “Kijimea Shop”) and govern use of the Kijimea Shop. Please read the GTC carefully before using the Kijimea Shop. By using the Kijimea Shop, you agree to be bound by the terms and conditions contained in the GTC. If you do not agree to the terms and conditions contained in the GTC, you may not access or otherwise use the Kijimea Shop. The Kijimea Shop is intended solely for the use of customers who intend to use Sellers’ products for their own use and not for resale.
We do not accept any changes to the GTC from the customer, and any such proposed changes shall be deemed to be rejected, whether or not we expressly object to such changes. If any part of these GTC are held by any court of law to be unlawful, invalid or unenforceable, this will not affect the validity of the remaining GTC, which will continue to be valid and enforceable to the fullest extent permitted by law.
Use of the Kijimea Shop is subject to the terms of our Privacy Policy, which is hereby incorporated into and made part of these GTC. We reserve the right, and you authorize us, to use information regarding your use of the Kijimea Shop, account registration, and any other personal information provided by you in accordance with our Privacy Policy.
All features, content, specifications, products and prices of products and services described or depicted in the Kijimea Shop are subject to change at any time without prior notice. Certain weights, measures and similar descriptions are approximate and are provided for convenience only.
The inclusion of any products or services in the Kijimea Shop at a particular time does not imply or guarantee that these products or services will be available at any time. It is your responsibility to ascertain and obey all applicable local, state, federal and international laws (including minimum age requirements) in regard to the possession, use and sale of any product or service purchased from the Kijimea Shop.
Account Registration
You may be required to establish an account on the Kijimea Shop in order to take advantage of certain features of the Kijimea Shop. If you provide information on the Kijimea Shop in connection with registering an account or otherwise, you agree to (a) provide true, accurate, current and complete information about yourself as prompted by the Kijimea Shop, and (b) maintain and promptly update such information to keep it true, accurate, current and complete. If you provide any information that is false, inaccurate, outdated or incomplete, or Seller has reasonable grounds to suspect that such information is false, inaccurate, outdated or incomplete, Seller has the right to suspend or terminate your account and prohibit any and all current or future use of the Kijimea Shop (or any portion thereof) by you.
If you register an account on the Kijimea Shop, you will create a username and password while completing the account registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to immediately notify Seller of any unauthorized use of your password or account or any other breach of security. You agree to be responsible for all charges resulting from the use of your account on the Kijimea Shop, including charges resulting from unauthorized use of your account prior to your taking steps to prevent such occurrence by changing your password and notifying Seller.
2 – Order Process
The presentation and advertising of products in the Kijimea Shop does not constitute a binding offer to conclude a purchase contract.
The customer can select goods using the "Add to Basket" button to place them in the virtual shopping cart. Products in the shopping cart can be deleted at any time, or the number of products can be changed. The customer can start the ordering process by clicking the "Checkout" button. Using the online order form made available in the Kijimea Shop, the customer can specify the order data, in particular the billing and delivery address, products, quantity and payment method. If customer has set up an account on the Kijimea Shop, then the customer may log in to such account with an email address and password.
Once an order form is submitted by the customer by means of clicking on the "Order with payment" button in the Kijimea Shop, the customer makes a legally binding offer to purchase the goods in the shopping cart.
Before submitting the order using the Seller's online order form, the customer can identify possible input errors by carefully reading the information displayed on the screen. The customer can correct their entries made as part of the electronic ordering process until they click the "Order with payment" button, which completes the ordering process.
When an order is placed by the customer using the Seller's online order form, a copy of the order is sent to the customer in text form (e.g. email), along with these GTC. Such an email does not constitute a binding acceptance of the order, unless it also declares acceptance in addition to confirmation of receipt. In addition, the order is archived by the Kijimea Shop and can be accessed free of charge by the customer via their customer account; provided that the customer has created a customer account in the Kijimea Shop before or after submitting their order.
The customer is responsible for validating that they can receive the emails sent by the Seller (as part of the order process) to the email address that the customer provided when placing the order.
A contract is only concluded between the customer and Seller when we accept the customer's order by means of a declaration of acceptance or by delivering the ordered products, except that when you pay by credit card, Google Pay, Apple Pay, or PayPal, the order is accepted immediately upon placing your order. Once the contract is concluded, the customer shall still have the right to cancel the order in accordance with Section 8 of these GTC.
In addition, once the contract is concluded, we reserve the right, without prior notice, to limit the order quantity on any product or service and/or to refuse service to any customer.
3 - Prices and shipping costs
All prices in the Kijimea Shop do not include taxes. Shipping costs also apply to each purchase in the Kijimea Shop.
The shipping costs are stated in the price information in the Kijimea Shop. The price including taxes and any shipping costs incurred is also displayed in the order form at checkout before the customer submits the order. If the shipping address provided is incorrect and subsequently the parcel is returned to our return address there will be an additional charge to re-ship the order.
Shipping is free for any subscription orders.
4 - Terms of payment, offsetting, retention
The customer can pay by PayPal, accepted credit card or debit card, Apple Pay or Google Pay. It is only possible to pay for a subscription with a credit card, debit card or Pay Pal.
Payment of the purchase price is due from customer, without offset or deduction, immediately upon conclusion of the contract. When paying by Apple Pay, Google Pay, credit card or debit card, the credit card or debit card account will be charged for the full order value after receipt of the order.
If you select payment via PayPal, you will be redirected directly to the PayPal website. After logging in with the PayPal access data, the payment must be confirmed to us and is then made directly via the customer's PayPal account.
In the event legal action is necessary to collect on balances due, you agree to reimburse Seller and its agents for all expenses incurred to recover sums due, including attorneys' fees and other legal expenses.
5 - Delivery conditions
Delivery is made by shipping to the delivery address specified by the customer in the order.
Delivery times specified by the Seller are calculated from the time of order confirmation. If no delivery time is specified for the respective product in the Kijimea Shop, Seller shall use reasonable commercial efforts to deliver an ordered product within two (2) to five (5) working days after order confirmation. No deliveries are made on Sundays and public holidays. Adverse weather conditions or other events outside of our reasonable control may result in the occasional late or cancelled delivery.
6 - Subscription
You have the option of taking out subscriptions ("subscriptions") for selected products in the Kijimea Shop in order to achieve a recurring order of the desired products. Select delivery cycles (e.g. every 30 days) are available for certain products, depending on the respective pack size or variant.
The term of a subscription is unlimited and can be cancelled at any time with or without cause. A declaration of cancellation by email to customerservice@kijimea.com is sufficient, but a declaration of cancellation is also possible via a corresponding button in the customer account. Goods shipped before receipt of the declaration of cancellation shall not be deemed to be covered by the cancellation.
The total price per billing period corresponds to the price for the selected product and delivery cycle. For certain subscriptions, not all of the payment methods listed in section 4 may be available.
You also have the option of interrupting a subscription at any time. In this case, no goods will be sent and no invoices will be issued for the suspension period. Goods shipped before receipt of the declaration of suspension shall not be deemed to be covered by the suspension.
Subscription discounts or offers: When provided a discount for a subscription, this may only be redeemable for certain products, for example, those items presented on the product page where the discount code was advertised, or per the terms stated in an email. Subscription discounts are only valid on subscription purchases, and not "one time" orders. If a subscription is cancelled, the discount code will not be redeemable against future purchases, unless otherwise stated. Subscription discounts are only available for new subscription customers, unless otherwise stated.
7 – Disclaimer of Warranties; Limitation of Liability
THE LAWS OF CERTAIN JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LEGAL WARRANTIES AND THE EXCLUSION OR LIMITATION OF REPRESENTATIONS MADE CONCERNING GOODS OR SERVICES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE BELOW EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU.
Though we endeavour to validate that information on the Kijimea Shop is complete, accurate and current, information in the Kijimea Shop may occasionally be inaccurate, incomplete or out of date. We make no representation as to the completeness, accuracy or currentness of any information on the Kijimea Shop. For example, products included on the Kijimea Shop may be unavailable, may have different features than those listed, or may have a different price than that stated on the Kijimea Shop.
THE KIJIMEA SHOP, CONTENT THEREON, AND PRODUCTS ARE FURNISHED TO YOU WITHOUT WARRANTIES, REPRESENTATIONS OR CONDITIONS, STATUTORY OR OTHERWISE, OF ANY KIND. SELLER, ON BEHALF OF ITSELF AND ITS AFFILIATES, LICENSORS, SUPPLIERS AND THIRD PARTY SERVICE PROVIDERS, AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, THE “SELLER PARTIES”): (A) EXPRESSLY DISCLAIMS ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF NON-INFRINGEMENT, TITLE, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE; (B) DO NOT REPRESENT OR WARRANT THAT THE KIJIMEA SHOP, CONTENT, PRODUCTS OR SUBSCRIPTIONS WILL MEET YOUR REQUIREMENTS, OR THAT THE OPERATION OF THE KIJIMEA SHOP OR CONTENT WILL BE TIMELY, UNINTERRUPTED, STABLE, OR SECURE; (C) DO NOT REPRESENT OR WARRANT THAT THE KIJIMEA SHOP, CONTENT THEREON, OR PRODUCTS WILL BE ERROR-FREE OR THAT ANY DEFECTS WILL BE CORRECTED; (D) DO NOT REPRESENT AND WARRANT THAT THE KIJIMEA SHOP WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; AND (E) DO NOT MAKE ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS REGARDING THE USE OF THE KIJIMEA SHOP, CONTENT OR PRODUCTS IN TERMS OF THEIR ACCURACY, RELIABILITY, TIMELINESS, COMPLETENESS, OR OTHERWISE. THE INFORMATION CONTAINED IN THE KIJIMEA SHOP IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND IS NOT MEANT TO SUBSTITUTE FOR THE ADVICE PROVIDED BY YOUR DOCTOR OR OTHER HEALTH CARE PROFESSIONAL. YOU SHOULD NOT USE THE INFORMATION AVAILABLE ON OR THROUGH THE KIJIMEA SHOP FOR DIAGNOSING OR TREATING A HEALTH PROBLEM OR DISEASE, OR PRESCRIBING ANY MEDICATION. THIS LIMITATION OF WARRANTIES IS A PART OF THE BARGAIN BETWEEN YOU AND SELLER. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY SELLER OR ANY PERSON ON BEHALF OF SELLER SHALL CREATE A WARRANTY OR CONDITION, OR IN ANY WAY CHANGE THIS EXCLUSION OF WARRANTY.
Limitation of Liability
THE LAWS OF CERTAIN JURISDICTIONS, DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY OR OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE BELOW EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
IN NO EVENT SHALL THE SELLER PARTIES BE LIABLE TO YOU, OR ANY THIRD PARTY, FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, EXEMPLARY, RELIANCE, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, PROPERTY DAMAGE, LOSS OF VALUE OF ANY PRODUCTS OR LOSS OF USE OF PRODUCTS, WHETHER BASED ON BREACH OF ANY EXPRESS OR IMPLIED WARRANTY OR CONDITION, BREACH OF CONTRACT OR TORT (INCLUDING, WITHOUT LIMITATION, NEGLIGENCE OR STRICT LIABILITY), EVEN IF A SELLER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OTHER THAN SET OUT ABOVE, THE SELLER’S MAXIMUM LIABILITY ARISING OUT OF ANY ORDER FOR THE SUPPLY OF GOODS UNDER THIS CONTACT WILL BE LIMITED TO THE RETAIL PRICE OF THE GOODS AND COST OF DELIVERY IN RELATION TO THAT ORDER.
8 – Cancellation & Refund Policy
You may cancel an order or subscription as set forth in this section 8.
30-day money-back guarantee
We offer you a 30-day money-back guarantee. If you have purchased a Kijimea product in the Kijimea Shop and are not satisfied with our service, you can make use of our 30-day money-back guarantee under the conditions set out below.
You can submit your money-back guarantee request via our returns portal. After receiving your return, we will refund the purchase price including delivery costs (with the exception of additional costs resulting from your choosing a different type of delivery than the cheapest standard delivery offered by us) at the latest within fourteen days from the day on which we received notification of your return request. For this refund, we will use the same means of payment that you used for the original transaction, unless something else is expressly agreed with you.
What are the conditions for the 30-day money-back guarantee?
- The money-back guarantee can only be claimed within 30 days of purchase.
- The money-back guarantee can only be claimed once per product.
- If you have ordered a product multiple times, the money-back guarantee can only be claimed for one product.
Consequences of cancellation for subscriptions
If you cancel a subscription we will refund any payments that we may receive after the date of cancellation, including delivery costs (with the exception of additional costs resulting from your choosing a different type of delivery than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the date on which we received notification of your cancellation of this contract. 9 – Complaints
Please contact us if you are not happy with any order or service you receive from us, as we always want to be made aware of, and have the opportunity to respond to, customer complaints. Please email us at customerservice@kijimea.com and include your name, order number and contact number so we can be in touch with you as soon as possible.
10 – Product Reviews
We value authentic customer experiences. If we send you a product review submission form by email, we encourage you to send us your product review via such form. We strive to publish all authentic product reviews, both positive and negative, that comply with our review guidelines set out below. We do not edit reviews except as permitted under these guidelines.
By submitting a review, you acknowledge and agree that:
- You are solely responsible for any content, opinion, statement, recommendation or advice contained in your review.
- You hold us and any person acting on our behalf harmless from any liability related in any way to the use of your review.
- By posting a review, you give us a non-exclusive, royalty free license to use your review. This allows us to display, share, reproduce, edit for clarity or formatting (without changing your meaning), and publish your review in any media. We may also make your review available to third parties for promotion or syndication. You also allow us to use the name you provided with your review.
Review Guidelines
We reserve the right to refuse to publish or remove any Review in our sole discretion. In particular, we reserve the right not to publish your review or to remove any published review if we determine in our sole discretion that a Review:
- Contains a reference to an illness or any form of health claim.
- Is false, unlawful, misleading, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing (or advocates harassment of another person), threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent or otherwise objectionable;
- Is patently offensive to the online community, such as that which promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
- Would constitute, encourage, promote or provide instructions for conduct of an illegal activity, a criminal offense, give rise to civil liability, violate the rights of any party in any country of the world, or that would otherwise create liability or violate any local, national or international law;
- Provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy or providing or creating computer viruses;
- May infringe any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party;
- Constitutes mass mailings or “spamming”, “junk mail”, “chain letters” or “pyramid schemes”;
- Impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity, including Kijimea Inc.;
- Is private information of any third party, including, without limitation, addresses, phone numbers, email addresses, social security numbers and credit card numbers;
- Includes or is intended to facilitate viruses, corrupted data or other harmful, disruptive or destructive files;
- Is unrelated to the product’s quality, health benefits, or nutritional value, or primarily addresses administrative issues best handled by customer service (e.g. subscriptions or cancellations).
- Restricts or inhibits any other person from using or enjoying the Kijimea Shop, or
- May expose the Seller or its users to any harm or liability of any type.

11- Proprietary Rights
You acknowledge that all materials on the Kijimea Shop, including any of the Kijimea Shop’s design, graphics, text, sounds, pictures, software and other files and the selection and arrangement thereof (collectively, "Materials"), are the property of Seller or its licensors, and are subject to and protected by United States and international copyright and other intellectual property laws and rights. All rights to Materials not expressly granted in these GTC are reserved to their respective copyright owners. Except as expressly authorized by these GTC or on the Kijimea Shop, you may not copy, reproduce, distribute, republish, download, perform, display, post, transmit, exploit, create derivative works or otherwise use any of the Materials in any form or by any means, without the prior written authorization of Seller or the respective copyright owner. Seller authorizes you to view and download the Materials only for personal, non-commercial use, provided that you keep intact all copyright and other proprietary notices contained in the original Materials. You may not modify or adapt the Materials in any way or otherwise use them for any public or commercial purpose.
Certain trademarks, trade names, service marks and logos used or displayed on the Kijimea Shop are registered and unregistered trademarks, trade names and service marks of Seller and its affiliates. Other trademarks, trade names and service marks used or displayed on the Kijimea Shop are the registered and unregistered trademarks, trade names and service marks of their respective owners. Nothing contained on the Kijimea Shop grants or should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademarks, tradenames, service marks or logos displayed on the Kijimea Shop without the written permission of Seller or such other owner.
12 - Applicable Law
Applicable federal law, and the laws of the state of New York, without regard to principles of conflict of laws, will govern these GTC and any dispute of any sort that might arise between you and Seller.
13- Changes to GTC
These GTC may be revised at any time and from time to time by updating this posting. You should visit this page from time to time to review the then current GTC because they are binding on you.
14- Termination
You or Seller may suspend or terminate your account or your use of the Kijimea Shop at any time, for any reason or for no reason. You are personally liable for any orders placed or charges incurred through your account prior to termination. We reserve the right to change, suspend, or discontinue all or any aspect of this Kijimea Shop at any time without notice.
